Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

It is a matter of fact that Europe is facing more and more crucial challenges regarding health and social care due to the demographic change and the current economic context. The recent COVID-19 pandemic has stressed this situation even further, thus highlighting the need for taking action. Active and Assisted Living technologies come as a viable approach to help facing these challenges, thanks to the high potential they have in enabling remote care and support. Broadly speaking, AAL can be referred (...) to as the use of innovative and advanced Information and Communication Technologies to create supportive, inclusive and empowering applications and environments that enable older, impaired or frail people to live independently and stay active longer in society. AAL capitalizes on the growing pervasiveness and effectiveness of sensing and computing facilities to supply the persons in need with smart assistance, by responding to their necessities of autonomy, independence, comfort, security and safety. The application scenarios addressed by AAL are complex, due to the inherent heterogeneity of the end-user population, their living arrangements, and their physical conditions or impairment. Despite aiming at diverse goals, AAL systems should share some common characteristics. They are designed to provide support in daily life in an invisible, unobtrusive and user-friendly manner. Moreover, they are conceived to be intelligent, to be able to learn and adapt to the requirements and requests of the assisted people, and to synchronise with their specific needs. Nevertheless, to ensure the uptake of AAL in society, potential users must be willing to use AAL applications and to integrate them in their daily environments and lives. In this respect, video- and audio-based AAL applications have several advantages, in terms of unobtrusiveness and information richness. Indeed, cameras and microphones are far less obtrusive with respect to the hindrance other wearable sensors may cause to one’s activities. In addition, a single camera placed in a room can record most of the activities performed in the room, thus replacing many other non-visual sensors. Currently, video-based applications are effective in recognising and monitoring the activities, the movements, and the overall conditions of the assisted individuals as well as to assess their vital parameters. Similarly, audio sensors have the potential to become one of the most important modalities for interaction with AAL systems, as they can have a large range of sensing, do not require physical presence at a particular location and are physically intangible. Moreover, relevant information about individuals’ activities and health status can derive from processing audio signals. Nevertheless, as the other side of the coin, cameras and microphones are often perceived as the most intrusive technologies from the viewpoint of the privacy of the monitored individuals. This is due to the richness of the information these technologies convey and the intimate setting where they may be deployed. Solutions able to ensure privacy preservation by context and by design, as well as to ensure high legal and ethical standards are in high demand. After the review of the current state of play and the discussion in GoodBrother, we may claim that the first solutions in this direction are starting to appear in the literature. A multidisciplinary debate among experts and stakeholders is paving the way towards AAL ensuring ergonomics, usability, acceptance and privacy preservation. The DIANA, PAAL, and VisuAAL projects are examples of this fresh approach. This report provides the reader with a review of the most recent advances in audio- and video-based monitoring technologies for AAL. It has been drafted as a collective effort of WG3 to supply an introduction to AAL, its evolution over time and its main functional and technological underpinnings. In this respect, the report contributes to the field with the outline of a new generation of ethical-aware AAL technologies and a proposal for a novel comprehensive taxonomy of AAL systems and applications. Moreover, the report allows non-technical readers to gather an overview of the main components of an AAL system and how these function and interact with the end-users. The report illustrates the state of the art of the most successful AAL applications and functions based on audio and video data, namely lifelogging and self-monitoring, remote monitoring of vital signs, emotional state recognition, food intake monitoring, activity and behaviour recognition, activity and personal assistance, gesture recognition, fall detection and prevention, mobility assessment and frailty recognition, and cognitive and motor rehabilitation. For these application scenarios, the report illustrates the state of play in terms of scientific advances, available products and research project. The open challenges are also highlighted. The report ends with an overview of the challenges, the hindrances and the opportunities posed by the uptake in real world settings of AAL technologies. In this respect, the report illustrates the current procedural and technological approaches to cope with acceptability, usability and trust in the AAL technology, by surveying strategies and approaches to co-design, to privacy preservation in video and audio data, to transparency and explainability in data processing, and to data transmission and communication. User acceptance and ethical considerations are also debated. Finally, the potentials coming from the silver economy are overviewed. (shrink)

Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. The findings should be considered in the development of Government policy and guidance regarding the role of families in deceased organ donation. (shrink)

This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. This dissertation focuses on teleology and functions in biology. More precisely, it focuses on the scientific legitimacy of teleofunctional attributions and explanations in biology. It belongs to a multi-faceted debate that can be traced back to at least the 1970s. One aspect of the debate concerns the naturalization of functions. Most authors try to reduce, translate or explain functions and teleology in terms of efficient causes so that they find their place in the framework of the natural sciences. Our approach (...) here is radically different, as we question the premise that teleological explanations are disguised causal explanations. On the contrary, we defend that they are acceptable in natural sciences and in biology in particular. We challenge the idea that teleological explanations are immature causal explanations, as well as the idea that teleology and functions are some sort of intentional explanations. We therefore reject the accusations of anthropomorphism, vitalism and finalism. On the contrary, we defend that teleology, causality and intentionality correspond to different, autonomous and complementary modes of representation of the outside world. -/- ———[FRANÇAIS]——— -/- Ce travail de thèse porte sur la téléologie et les fonctions en biologie. Plus précisément, il porte sur la légitimité scientifique des attributions et des explications téléofonctionnelles en biologie. Il s’inscrit dans le cadre d’un débat à plusieurs facettes que l’on peut faire remonter au moins jusqu’aux années 1970 et qui est encore très actif aujourd’hui. L’un des aspects du débat porte sur la naturalisation des fonctions, c’est-à-dire sur la manière de les réduire, de les traduire ou de les expliciter en termes de causes efficientes de sorte qu’elles trouvent leur place dans le cadre des sciences de la nature. Notre approche ici est radicalement différente, car nous remettons en question la prémisse selon laquelle les explications téléologiques seraient des explications causales déguisées. Nous défendons au contraire qu’elles sont acceptables en tant que telles aussi bien de façon générale que dans le domaine scientifique et en particulier en biologie. De façon générale, nous remettons en question l’idée selon laquelle la pensée téléologique serait une pensée causale immature, ainsi que sa dépendance présumée vis-à-vis de la psychologie, c’est-à-dire de l’intentionnalité. Nous rejetons donc les accusations d’anthropomorphisme, de vitalisme et de finalisme formulées contre elle. Nous défendons au contraire que la téléologie, la causalité et l’intentionnalité correspondent à des modes différents, autonomes et complémentaires de représentation du monde extérieur. (shrink)

In this paper, we propose to study the problem of universals in Thomas Aquinas with ‘’analytic glasses’’ (according to the famous phrase of Jonathan Barnes). Starting with the semantic criteria of Peirce used by Armstrong, we propose to present a new reading of the position of Thomas, especially of the De ente et essentia . We introduce the thesis of Thomas Aquinas in contemporary discussions highlighting the difficulty of classifying Thomas Aquinas as a realist or as a universalist. Our main (...) goal is thus to present a new reading of the position of Aquinas, while showing how and why his thesis might be a promising solution in the discussion of the problem of universals. Is the boundary between the normal and the pathological real or fiction? Are health and disease just a matter of fact or are they value-laden? Here we present some examples of how alleged diseases can be invented and propagated by the industry (disease mongering) or by the methodology of medical science itself. We show that the boundary between health and disease is blurred and depends on individual and social representations, culture relative ways of categorising things and people, and by the (...) society’s degree of medicalisation. However, we do not mean that it is not real, rather that it is more complex than expected, as the subjectivity of social constructions and individual experiences makes them no less real. Finally, we conclude that health and disease belong to both objective and subjective kinds of reality, so the fictional can be real. (shrink)

In Ancient Greece, the figure of the hero was identified as a demigod, possessed of altruistic and virtuous deeds. When Pierre de Coubertin reinstated the Olympic Games, the athlete was personified as a modern hero. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. Connecting the ethic with the aesthetic spheres, we could have in the sports a phenomenon walking toward a common point between moral and aesthetic, between the good and the beauty. (shrink)

En metafísica contemporánea, es común trabajar bajo una metodología basada en virtudes teóricas. En caso de disputa, esta metodología nos aconseja elegir la teoría que mejor satisfaga las virtudes teóricas estándar: precisión empírica, fecundidad, poder unificador, consistencia y simplicidad. Sin embargo, no hay consenso sobre cómo deben frasearse tales virtudes, ni sobre cómo ponderarlas. Aquí me concentraré en ofrecer razones a favor de una manera de frasear el principio de parsimonia ideológica, una especie de simplicidad. Defiendo que dicho principio debería (...) decir que, dadas dos teorías T1 y T2, ceteris paribus, si T1 postula menos tipos de expresiones primitvas que T2, entonces es más probable que T1 sea una teoría fiel a que T2 lo sea. Se elabora en qué consiste la cláusula ceteris paribus, qué quiere decir "postular menos tipos de expresiones primitivas" (parsimonia ideológica cualitativa) y en qué consiste la fidelidad teórica. El arte no es solamente una fuente inagotable de goce estético, es además una huella, una evidencia de nuestro pasado histórico. A partir del arte es posible remitirnos a nuestra raíz cultural, y es por eso que la obra artística constituye una parte importante del patrimonio de un pueblo. Es evidente el estrecho vínculo entre el patrimonio artístico y la identidad cultural; por eso es importante dar un justo valor a ese patrimonio que, a su vez, se reflejará en la (...) consolidación de una identidad propia. De esas expresiones tomamos únicamente las de la arquitectura de algunas iglesias barrocas. En ellas podemos notar una serie de variables del mestizaje cultural. La arquitectura del barroco novohispano, como uno de los lenguajes del arte, generó una reflexión sobre la identidad del individuo iberoamericano. (shrink)

A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. Finalmente, hacemos referencia al actual debate pro- y antidoxástico, haciendo hincapié en la necesidad de considerar la amplitud del concepto de creencia en su genealogía histórica. Con base en ello estaríamos en condición de acercarnos a la visión doxástica moderada que han defendido autoras como Lisa Bortolotti. (shrink)

Qu’est-ce que la théologie analytique ? Que veut la théologie analytique et que pouvons-nous attendre d’elle ? Ces questions semblent constituer le défi d’aujourd’hui pour la théologie analytique. Nous répondrons à ces questions, en proposant de la distinguer des autres disciplines avec lesquelles elle semble se confondre. Cette recherche nous conduira d’abord à proposer une nouvelle définition de la théologie analytique fondée sur trois critères et par la suite à distinguer deux manières de faire la théologie analytique: (i) une théologie (...) analytique de bas en haut et (ii) une théologie analytique de haut en bas. Selon notre thèse, seule une théologie analytique confessante de haut en bas peut être considérée comme une théologie analytique à part entière. (shrink)

L’auteur propose de montrer dans cette étude le lien entre la naissance de l’approche analytique de l’histoire de la philosophie et le travail réalisé par trois figures de l’histoire de la philosophie médiévale au XXème siècle : Kretzmann, Pinborg et Kenny. Materialism has been the subject of extensive and rich controversies since Robert Boyle introduced the term for the first time in the 17th century. But what is materialism and what can it offer today? The term is usually defined as the worldview according to which everything real is material. Nevertheless, there is no philosophical consensus about whether the meaning of matter can be enlarged beyond the physical. As a consequence, materialism is often defined in stark exclusive and reductionist terms: whatever (...) exists is either physical or ontologically reducible to it. This conception, if consistent, mutilates reality, excluding the ontological significance of political, economic, sociocultural, anthropological and psychological realities. Starting from a new history of materialism, the present book focuses on the central ontological and epistemological debates aroused by today’s leading materialist approaches, including some little known to an anglophone readership. The key concepts of matter, system, emergence, space and time, life, mind, and software are checked over and updated. Controversial issues such as the nature of mathematics and the place of reductionism are also discussed from different materialist approaches. As a result, materialism emerges as a powerful, indispensable scientifically-supported worldview with a surprising wealth of nuances and possibilities. (shrink)

En nuestro artículo, analizaremos las diferencias y similitudes que podemos encontrar en el uso de diagramas entre dos prácticas matemáticas de la antigüe-dad. Mostraremos que no existe un solo uso posible de éstos, sino que tienen que considerarse como herramientas de razonamiento creadas y manipuladas de acuerdo con los propósitos de cada tradición. Argumentaremos que las diferencias en los procedimientos y organizaciones del conocimiento que ambas tradiciones presentan no implican ningún tipo de valoración acerca de su mayor o menor "matematicidad", (...) ya que ambas tradiciones llegaron a resultados matemáticos suficientemente generales y precisos, hecho que es característico de investigaciones matemáticas a un nivel teórico. Среди выдающихся латиноамериканских философов, которые так или иначе занимаются аксиологическими nроблемами, находится месиканец Эдуардo Гарсия Майнез. По мнению Майнеза, каnитальные проблемы аксиологии могут быть сведены к четырем: а) проблема существования ценности; б) nроблема оценочного nознания; в) проблема реализации ценности; д) проблема свободы выбора личностью ценности. В данной работе анализируется в основном те идеи этого автора, которые касаются nервой из этих больших nроблем - вопроса о существовании ценностей. En opinión de Maynez los problemas capitales de la axiología son cuatro: a) el problema de la existencia del valor; b) el problema del conocimiento valorativo; c) el problema de la realización del valor; d) el problema de la libertad del hombre en la elección del valor. El presente ensayo plantea la posibilidad de considerar nuevamente al diseño editorial como una actividad artística. Este campo no pudo escapar al fenómeno de la sociedad del espectáculo que hoy envuelve a casi toda actividad humana. Ello indiscutiblemente afecta la manera en que se valora esta actividad actualmente, vista las más de las veces como un simple aditamento utilitario con más fines comerciales que artísticos. A pesar de ello no deja de ser loable una revaloración de la disciplina que la (...) considere como una producción también transutilitaria, un fenómeno a la vez estético y extraestético y una actividad que, a través de su propia praxis, construye al ser histórico... El presente trabajo nació como una reflexión posterior a la traducción del libro de Stanley Cavell Contesting Tears: The Hollywood Melodrama of the Unknown Woman. La reflexión era necesaria habida cuenta de las dudas suscitadas por la traducción del título del libro. Para ser más exacto, la reflexión giraba en torno a las lágrimas que forman parte de la primera parte del título, las lágrimas vertidas por las mujeres desconocidas que protagonizan los melodramas analizados en el libro. En mi opinión, (...) llegar a entender la razón y la naturaleza de esas lágrimas es clave para comprender lo que Cavell nos viene contando desde hace cinco décadas. Por ello, lo que sigue intenta reunir mis propios comentarios sobre la obra de Cavell en general, con la justificación de la traducción final del título: Más allá de las lágrimas. (shrink)

Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. En el presente texto se sostiene que las categorías de primeridad, segundidad y terceridad —y las relaciones posibles entre ellas— revelan las operaciones lógicas de relación y ley en el trabajo de Charles Sanders Peirce. Para ello, se muestra su importancia a través de paralelismos con otras triadas del filósofo norteamericano. Para dicho propósito, el texto se divide el texto en tres momentos. El primer momento consiste en exponer la operación de la triada principal: primeridad, segundidad y terceridad. En esta (...) caracterización se pondrá especial énfasis en la descripción del tratamiento de lo indeterminado hecho por las operaciones de la ley y la relación en las categorías1. En segundo lugar, se reconstruye la operación peirceana de las tricotomías en el razonamiento lógico. Finalmente, se concluye recapitulando los puntos tratados, a la vez que se sugieren las razones del carácter tríadico de las categorías en Peirce y sus supuestos. (shrink)

Como parte del trabajo del taller interno permanente del Cuerpo Académico de Estética y Arte de la Benemérita Universidad Autónoma de Puebla, el 12 de noviembre de 2013 se realizó una Mesa Redonda sobre el tema “Universalidad e identidad cultural”. En esta Mesa participaron los doctores José Ramón Fabelo Corzo, José Antonio Pérez Diestre y Ramón Patiño Espino, como ponentes principales; además, se contó con la asistencia del doctor Jesús Márquez Carrillo, quien se integró al debate. Diferentes disciplinas —la (...) filosofía, la antropología, la historia del pensamiento y del arte, incluso la biología— pueden, cada una, ofrecer sus aportes al tan socorrido tema de la relación entre lo universal y lo propio en la cultura latinoamericana. El debate suscitado puso de manifiesto esa diversidad de aportaciones. En este trabajo presentamos las intervenciones realizadas por cada uno de los integrantes de la mesa, en el orden en que se produjeron. (shrink)

El libro de María González Navarro se presenta a sí mismo como una “nueva hermenéutica” (23). La novedad involucra dos aspectos: uno que llamaremos metateórico y otro hermenéutico en propiedad. Hablando metateóricamente, el libro presenta una hermenéutica gadameriana vigorizada y robustecida por las teorías pragma-dialécticas de la argumentación. Desde el punto de vista hermenéutico propiamente dicho, la novedad reposa en que se considera que la interpretación correcta está indesligablemente vinculada a la argumentación abductiva.

El presente libro busca aportar desde la academia algunas visiones sobre los debates vigentes de la donación y trasplante de órganos. Esto, por medio del estudio juicioso de la normatividad y la jurisprudencia, así como de la solución de controversias que no están legisladas y les corresponde a los administradores de justicia resolverlas. Asimismo, señala la necesidad de regular los aspectos aquí planteados que, por los vacíos normativos, dificultan la realización del procedimiento médico de trasplante y donación de órganos.

En este artículo reconstruyo y analizo las respuestas de los escépticos académicos a la objeción de apraxia. Esta objeción afirma que el escepticismo es una doctrina imposible de practicar puesto que sus tesis conducen a la apraxia, esta es, un estado de privación o imposibilidad de acción. Las respuestas a la objeción se dividen en dos clases. La primera prueba que el asentimiento no es una condición necesaria para realizar acciones, por lo que la recomendación escéptica de suspender global y (...) permanentemente el asentimiento no conduciría a la apraxia. La segunda prueba que es posible deliberar y orientar racionalmente nuestras acciones sin impresiones aprehensivas, por lo que la tesis escéptica de que no existen impresiones aprehensivas tampoco conduciría a la apraxia. Tras unas breves consideraciones generales, en la primera parte de este artículo presento las respuestas de Arcesilao y en la segunda parte las repuestas de Carnéades. (shrink)

This article deals with Bartolome´ de Las Casas’ contribution to the notion of universal human rights. Though much study has been devoted to Las Casas’ work, what remains understudied is the Spanish philosopher’s conception of religion, which in many ways resembles what Kant called “the religion of reason.” For Las Casas, then, Christianity was conceived more as a rational system of ethics than as a compendium of Biblical and scholastic dogmas. Like the later Enlightenment philosopher Johann Gottlieb Fichte, Las Casas (...) believed that all humans belonged to the same universal community of rational beings. By examining Las Casas together with Fichte, this article sheds further light on Las Casas’ anticipatory notions of moral agency, formal freedom, rational religion, and the rights of a free people against the use of coercion—regardless of their race, religion, or culture. They are the ideas underpinning his notion of universal human rights (Paulist and Thomist in nature), and his ethics of the Other, who “is just like me”: a rational, feeling human being, deserving of equal justice and rights. En el presente texto se defenderá la idea según la cual, la filosofía y el filosofar están intrínsecamente ligados. Se partirá de un caso paradigmático, el caso de la filosofía analítica. A partir de su definición,se pretenderá mostrar que las características más sobresalientes de dicha corriente están fundamentalmente ligadas al acto de filosofar.Por medio de dicho ejemplo, se desea mostrar que enseñar la filosofía consiste en enseñar a filosofar, y que por lo tanto una no puede ser separada de la (...) otra. Aprender a filosofar es entonces, aprender a ver un problema detrás de cada página de un texto filosófico, una argumentación detrás de cada problema y finalmente, una verdad detrás de cada argumentación. Can we reify the form of a substance? Is it possible to identify DNA as the principle of our personal and numerical identity? These questions will be studied through Berti’s reading of Aristotle’s hylomorphism. Indeed, Enrico Berti proposes the identification of the DNA to the Aristotelian notion of form, thesis which raises many questions from an exegetical point of view and a metaphysical perspective. We will present the sources of Berti’s reading and one of the main objections made by Aristotle. (...) Thus, different versions of the Berti’s thesis will be examined and then, a thought experiment that makes them false. Finally, it will be proposed an aristotelian solution, coming from a contemporary Aristotelian (E. J. Lowe), that seems to prevent Berti’s mistakes and gives us a robust metaphysics of the identity. Le titre de cette étude suggère de traiter trois termes, à premier vue, sans aucun lien. En effet, quel peut être le lien entre l’homosexualité et la Bible? Ou celui entre l’homosexualité et les sciences cognitives? Et finalement, quel lien peut-il y avoir entre ces trois termes à première vue juxtaposés? Il y a une réponse à chacune de ces trois questions et nous proposons d’explorer ces réponses dans le cadre de cette étude. El presente artículo introduce el lector a la filosofía analítica de la religión desde un punto de vista histórico y haciendo énfasis en su evolución. El objetivo es doble: primero dar a conocer una nueva disciplina que se ha desarrollado de manera notoria dentro del habla inglesa pero que ha sido ignorada dentro de la filosofía de habla hispana; segundo, comprender su nacimiento y algunas de sus principales características.

Dans cette étude nous nous proposons d’étudier la présence du Christ dans l’Eucharistie dans une perspective métaphysique et ontologique. Dans les deux premières sections nous définirons et montrerons qu’il faut distinguer: le problème de l’Eucharistie et la question fondamentale de l’Eucharistie. Nous défendrons la thèse selon laquelle le problème de l’Eucharistie en est vraiment un seulement pour ceux qui acceptent l’ontologie de l’aristotélisme, plus précisément celle de la transsubstantiation. Or, nous montrerons que l’ontologie de la transsubstantiation suppose des problèmes théoriques (...) insurmontables et nous suggérerons que nous devons nous intéresser plutôt à la question fondamentale de l’Eucharistie. Afin de montrer qu’il est possible de donner une réponse à la question fondamentale de l’Eucharistie, nous esquisserons une solution à partir d’une ontologie des tropes. (shrink)

La metafísica después de ser ignorada por años ha regresado al centro de la escena en la filosofía contemporánea. Tomás de Aquino ha vivido una historia muy parecida, lo que dio nacimiento al tomismo analítico. A pesar de los trabajos desarrollados en esta línea de investigación, la metafísica del Aquinate ha sido fuertemente ignorada. Sin embargo, la metafísica de Tomás de Aquino tiene una ventaja, poco discutida entre los tomistas y tomasinos, y es la de ser una metafísica esencialista. Así, (...) en armonía con el trabajo del metafísico E. J. Lowe, quien presenta su metafísica como “esencialista seria”, se quiere mostrar que la metafísica del Aquinate tiene las mismas virtudes del “esencialismo serio”, lo que permite postularla como una posición válida y plausible para la metafísica contemporánea. Finality, design and purpose have started to be excluded from the language of the natural sciences since the XVIIth century. Darwin succeeded in excluding them from his theory of evolution appealing to a blind and mechanical natural selection. Today, the most usual definitions for the concept of biological function take for granted that functions: 1) are not dependent on a goal; 2) are not dependent on observers, but only on nature; 3) are explicable in causal terms, either with reference to (...) the causal history of the organ (etiological definition), or with reference to its present structure and causal capabilities (dispositional definition). However, we shall see that such presuppositions cannot take into account the normative character of the concept of biological function. We show that a generalization of the concept of scientific objectivity lets us affirm that functions: 1’) are dependent on a goal; 2’) are dependent on both observers and nature; 3’) cannot be reduced to causality, nor break the laws of physics; and yet, 4) are truly objective. La teorı́a literaria contemporánea plantea desafı́os complejos para el estudio del lenguaje en su generalidad, sobre todo al tener en cuenta su función referencial, significado y la formulación del conocimiento en un paradigma de mediación. Las premisas de un lenguaje retórico parecen llevar a la teorı́a al más profundo de los pesimismos, poniendo en duda su finalidad y orientación crı́tica. El presente trabajo se propone investigar el carácter del significado y la función referencial a partir de la teorı́a tropológica de (...) Paul de Man, cometido que tiene tras de sı́ la necesidad de fundamentar una teorı́a literaria optimista en el encuentro entre figuración y conocimiento. Por medio de una atenta lectura de la retórica de Paul de Man, el trabajo presenta una solución tentativa al problema del conocimiento en el lenguaje retórico mediante una visión que entraña la inseparabilidad entre contenido y forma. De esa manera, la teorı́a literaria quedarı́a a salvo de ser una corriente contraria a la posibilidad de conocimiento sin traicionar sus propios postulados, como también la  forma  pasarı́a a ser parte del campo de estudio de la epistemologı́a. Y-a-t-il une inconsistance entre la thèse d’un Dieu chrétien et l’existence du mal ? Notre argumentation se basera sur l´excellente thèse développée par Alvin Plantinga, qui soutient, contre John L. Mackie, la consistance du théisme face au problème du mal. Cependant, nous refuserons de suivre la métaphysique modale adoptée par Alvin Plantinga et proposerons une position actualiste, et plus précisément l’essentialisme sérieux prôné par E. J. Lowe. Nous montrerons qu’il est alors possible de suivre l’argumentation logique de Plantinga tout en (...) soutenant un essentialisme sérieux. (shrink)

[ENGLISH] This article discusses the potential of synthetic biology to address fundamental questions in the philosophy of biology regarding the nature of life and biological functions. Synthetic biology aims to reduce living organisms to their simplest forms by identifying the minimal components of a cell and also to create novel life forms through genetic reprogramming, biobrick assembly, or novel proteins. However, the technical success of these endeavors does not guarantee their conceptual success in defining life. There is a lack of (...) consensus among researchers on how to define and classify the entities produced in the lab, whether they should be considered living or categorized differently. The criteria for minimal cells and minimal life are subject to arbitrary choices and varying interpretations. The concept of function, crucial to synthetic biology, is also difficult to define. The article highlights the need to consider the minimal set of functions that characterize life before determining the smallest genomes that code for those functions. The arbitrary nature of defining both life and function complicates the understanding and classification of these entities. The article suggests that the traditional dichotomy between the living and the non-living may no longer be valid and that the concept of life itself may not require precise scientific definition. As synthetic biology advances, the article emphasizes the importance of redefining or constructing new categories to encompass the expanding possibilities and creations in the field. The ability to create new life forms raises questions about recognition, identification, and ethical implications, requiring a conceptual and philosophical engagement beyond the technical achievements of synthetic biology. -/- [FRENCH] L'article aborde le potentiel de la biologie synthétique pour répondre à des questions fondamentales de la philosophie de la biologie concernant la nature de la vie et des fonctions biologiques. La biologie synthétique vise à réduire les organismes vivants à leurs formes les plus simples en identifiant les composants minimaux d'une cellule et à créer de nouvelles formes de vie grâce à la reprogrammation génétique, à l'assemblage de biobriques ou à des protéines nouvelles. Cependant, le succès technique de ces approches ne garantit pas leur réussite conceptuelle dans la définition de la vie. Il n'y a pas de consensus parmi les chercheurs sur la façon de définir et de classer les entités produites en laboratoire, qu'elles doivent être considérées comme vivantes ou catégorisées différemment. Les critères des cellules minimales et de la vie minimale sont soumis à des choix arbitraires et à des interprétations variables. La notion de fonction, essentielle en biologie synthétique, est également difficile à définir. L'article met en évidence la nécessité de prendre en compte l'ensemble minimal de fonctions qui caractérisent la vie avant de déterminer les plus petits génomes qui codent ces fonctions. La nature arbitraire de la définition de la vie et de la fonction complique la compréhension et la classification de ces entités. L'article suggère que la dichotomie traditionnelle entre le vivant et le non-vivant pourrait ne plus être valable et que le concept même de vie ne nécessite pas une définition scientifique précise. À mesure que la biologie synthétique progresse, l'article souligne l'importance de redéfinir ou de construire de nouvelles catégories pour englober les possibilités et créations croissantes dans le domaine. La capacité à créer de nouvelles formes de vie soulève des questions de reconnaissance, d'identification et d'implications éthiques, nécessitant une réflexion conceptuelle et philosophique au-delà des avancées techniques de la biologie synthétique. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Se valoran las principales ideas axiológicas de filósofo mexicano Miguel Bueno, a través de una de sus obras medulares –“Contribución a la teoría de los valores”– con el objetivo de desentrañar, su comprensión tanto de la naturaleza de los valores, como de su jerarquía de los valores, aspectos estos nodales de la concepción axiológica del autor. Sobre esta base se realiza un enjuiciamiento crítico de sus propuestas teóricas.

Spanish Abstract: A partir de un análisis desde la historia del derecho, este artículo de investigación busca demostrar la existencia de un significado de justicia social en el discurso jurídico transnacional actual que se resume en la garantía de estos tres elementos: Estado Social de Derecho, dignidad humana e igualdad de oportunidades. Con esto, se pretende superar el simple estudio de teorías de filósofos de moda como John Rawls a la hora de abordar el problema de cómo entender y materializar (...) la justicia social, particularmente, en el plano constitucional. Finalmente, con la ayuda de algunos breves estudios de caso, se espera proveer un marco mínimo útil para entender cómo la justicia social puede lograrse a través del derecho. -/- English Abstract: Based on an analysis from legal history, this paper seeks to prove the existence of a meaning of social justice in the current transnational legal discourse that can be synthetized in the warranty of these three elements: Social Rule of Law, human dignity, and equal opportunities. Thus, it aims to overcome the mere study of theories of justice drawn up by trendy philosophers like John Ralws when addressing the problem on how to understand and achieve social justice, specially, in constitutional law. Finally, with the help of some brief case studies, the author hopes to provide a minimum framework useful to understand how social justice can be realized through law. (shrink)

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. English Abstract: Through the presentation of the history of social justice in global constitutional discourse, this article aims to demonstrate that, although in Colombia there is not a constitutionalized purpose or principle of social justice, as in other countries, the modern notion of distributive justice, also called social justice today, is implicit in the Constitution of 1991 because it enshrined as mandatory rules the three main elements of its meaning at the time of its promulgation: the principle of social rule (...) of law, the principle of human dignity and the right to a material equality. Thus, in Colombia social justice must not be understood in the Aristotelian sense of distributive justice but in accordance with these three elements, and can only be achieved if they are fulfilled. -/- Spanish Abstract: Mediante la presentación de la historia de la justicia social en el discurso constitucional global, este artículo pretende demostrar que, a pesar de no existir en Colombia, como en otros países, un valor o principio constitucional de justicia social, la noción moderna de justicia distributiva, también llamada hoy justicia social, se encuentra implícita en la Constitución de 1991 porque esta consagró como normas obligatorias los tres elementos principales de su significado en el tiempo en el que fue promulgada: el principio de Estado Social de Derecho, el principio de dignidad humana y el derecho a una igualdad material. Así pues, la justicia social debe entenderse en Colombia a partir de esos tres elementos, no según el sentido aristotélico de justicia distributiva, y sólo puede ser alcanzada si ellos se cumplen. This monograph traces the history of the concept of Gay Science, made popular by Friedrich Nietzsche through his book The Gay Science. Contrary to Nietzsche’s mistaken notion of the concept, it did not refer to a Troubadour poetics, but rather to a post-Troubadour poetics of recuperation—the complete opposite of what Nietzsche had thought. This poetry was not sung to young maidens, but instead to the Virgin Mary. The poetics of the Gay Science is found in an eight hundred page compendium (...) entitled Las leys d’amors, compiled in 1536 by Guilhem Molinier, and edited by Joseph Anglade in 1919. This post-Troubadour poetics gave rise to two schools of gaya sciensa, one in Toulouse (“Consistoire du Gai Savoir” in 1323) and the other in Barcelona (“Consistori de Barcelona” in 1338), where floral games took place. The aim here, then, is to trace the genealogy of the gay science through the cultural history of Toulouse, Barcelona, the Spanish poets of the 15th century, and its last “inheritor,” Nietzsche. -/- . En la generación de daños ambientales los derechos individuales y colectivos pueden verse vulnerados, cuando se trata de comunidades indígenas, tribales y afrocolombianas, por la forma en la que estas conciben la naturaleza y la íntima relación que existe entre el ambiente y sus planes de vida. Por lo tanto, ante la presencia de daños en el ambiente de estas comunidades puede generarse de forma desencadenante un daño cultural, porque estas poblaciones son las que pierden el escenario raigal y ancestral (...) en el que desarrollan sus prácticas de identidad cultural. Precisamente, en el presente texto se pretende discernir si ante la presencia de un conflicto ambiental en el Arroyo de San Basilio de Palenque, que a su vez es centro de las relaciones socioeconómicas, culturales y lúdicas de los miembros de esta comunidad, se logra desencadenar un daño cultural.
